Bengal Kitten Sales Agreement & Health Guarantee

This Agreement (“Pet Agreement”) is entered into between Purr Palz (“Seller”) and PURCHASER NAME (“Purchaser”)
IN CONSIDERATION of the sum of Purchase Price _______________ Seller grants, conveys and transfers the following kitten   (“Bengal Kitten”) to Purchaser.
DESCRIPTION OF KITTEN: SBT Silver Bengal/Blue eye at birth. DOB:_________________ Female- For pet only
Sire: SBT Seal Silver Lynx

Purchaser has paid a non-refundable deposit of $500.00 The deposit shall be applied towards the purchase price_1700.00- total price of kitten. Total amount due 72 hours before delivery of kitten.

Deposits are non-refundable.
This agreement is made for our mutual benefit to protect the purchaser and the breeder, as well as to clear the conditions of purchase.  
Our kittens are guaranteed to be of good health at the time of sale. This kitten is guaranteed to be healthy and free of disease and other health conditions upon leaving Purr- Palz; (unless otherwise indicated and agreed on by Buyer and Seller). The general health guarantee period is 72 hours from take home date. Stress related health conditions are not part of this health guarantee and will not be covered. You must have the kitten examined by a certified veterinarian within 72 hours (or 3 business days) of receiving the kitten.  Kitten must remain quarantined in a clean environment and from other pets until first vet check.  Please note that failure to do this will render all guarantees null and void.  If an illness occurs during the 72-hour guarantee period, and is related to a congenital defect then the breeder must be notified immediately.  In the event of an unexpected un-treatable or life-threatening condition, Seller will replace kitten/cat with one of more than equal value or equal value as soon as one becomes available or as agreed upon by seller a full refund of kitten/cat.
Further, we guarantee all kittens for a period of two years against genetic or congenital defects that cause the passing of your kitten/cat.  If during this time your kitten/cat passes and your certified veterinarian finds it to be genetic or congenital defect, a Necropsy must be completed and cause of passing and as well as test result must be furnished to seller to obtain a full refund and or kitten/cat replacement.




Buyer Agrees:

 _____Seller recommends AGAINST the use of Ketamine as anesthesia.  There have been reports of Bengals dying with the use of Ketamine as anesthesia. (Never waking up) Isoflourine has proved to be a much safer anesthesia for Bengals. 

_____ To have the above said kitten/Cat examined by a certified veterinarian within 72 hours (or 3 business days) of receipt of said kitten, unless otherwise agreed on by seller.
_____ That kitten or cat is never to be resold or surrendered to a shelter or similar facility.
_____ To provide immediate medical care if the kitten shows signs of illness or distress.
_____ Buyer understands and agrees that certain conditions such as coccidiosis and upper respiratory illness can arise due to stress from change and/or other cats/kittens in buyers home and are not part of the health guarantee.
_____ Breeder is not liable for any contagious illness (FELV, FIV, Rhino, FIP etc) once the kitten leaves cattery,
_____ We make every effort to prevent parasites, Breeder is not liable for any parasite infection, once kitten/cat leaves our environment due to the fact we cannot control environment outside of our cattery.  
_____ Allow PURR PALZ to have their own veterinarian examine your kitten/cat, look at necropsy results, examine records, or contact your veterinarian for information to be able to guarantee replacement of above said kitten/cat or refund.

_____ Kitten/Cat is not to live in the following:  a caged environment, in isolation, in an outside caged hut type home, without shelter, or in an unsanitary environment. The above violations will cause stress and is a breeding ground for health & wellness disaster. Health Guarantee is null & void should these conditions occur.
_____The terms of this contract and any business dealings between Purr Palz and Buyer shall remain confidential. Never is any negative information such as disputes or health status of kitten/cat to be posted publicly on the internet or elsewhere. Issues will be resolved only between seller and purchaser. 

____HCM- I understand the latest research from Dr. Kate Muers from UC Davis school of Medicine  has stated in her webinar education (UC Davis) “Since HCM is generally adult onset, we recommend testing with an echocardiogram generally over 2 years of age but this could be earlier if there was a concern (the murmur in this kitten).” Typically, concern is a range 4 out of 6. Causation can be linked to congenital and or many other factors.  Fact: HCM can go unnoticed for up to 10 years. This means breeding cats should be tested every year for up to 10 years of age.  Purr- Palz nor any reputable breeder can determine HCM outcome until a genetic marker can be identified.   

___HCM: More research is needed- Continued research is still being conducted. Dr. Kate Muers does not recommend pulling a cat from the breeding poole solely on the basis of murmur or HCM; in fact she has stated on her webinar, if the cat is of outstanding quality, and has no other health issues a closer look is merited as pulling some of these cats would do harm to the lineage of ultra-good specimens. HCM is not a death sentence. Purr- Palz participates and advocates for healthy hearts.   HCM information gathered from: Kathryn M. ____FIP: More research is needed- FIP is much more common in multiple-cat households than it is in households with only one or two cats (which has led some experts to hypothesize that stress is a key factor in the development of the disease). FIP is caused by the mutation of the corona virus, which is highly contagious, as in passed through the litter box, food/water bowls, etc etc. Some cats can have the corona virus their whole lives and it will never mutate into FIP, others are not that lucky. There is actually NO test for FIP, it can only be confirmed through an autopsy and there is actually no precise test for the corona virus either, just a titer test, which certain levels of something in their blood can point towards them having the corona virus                     The wet form is usually fatal but the dry, if caught early, can be cured. Seller has no control over the environment once kitten/cat leaves the cattery. People have different definitions of clean and when to clean cat boxes, water/food dishes, and or toys/blankets or the like. Purr-Palz has the highest standards of cleanliness and sanitization.  Therefore, once kitten/cat leaves our safe environment we cannot prevent or protect the Kitten’s/Cat’s environment once it has left our premises.

Seller warrants that Kitten is sold in good health at the time Kitten leaves Seller's premises.  Seller further warrants that Kitten has undergone a physical examination by Seller's veterinarian prior to Kitten leaving Seller (including, but not limited to, an eye exam, ear exam, auscultation), and that Seller was not aware of any health issues (including, but not limited to, upper respiratory infections, diarrhea) at the time Kitten leaves Seller's premises.   However, the stress from the change in environment & travel may cause the Kitten to “break” with an infection, even though the Kitten showed no clinical signs of an infection when it left Seller’s premises.  This is why it is important for the Kitten to be checked within three (3) business days of receipt.   This health guarantee does not cover coccidia outbreaks.  When a kitten goes into its new home, this can sometimes result in diarrhea/loose stools a few days after arrival.  This is typically caused by the parasite coccidia.  This is not a congenital problem and is not covered by our health guarantee.
Unless otherwise agreed between the parties in writing, the Purchaser has three (3) business days of receipt of the Kitten to have Kitten examined by Purchaser's veterinarian. Purchaser shall provide Seller with proof of the examination upon Seller’s request.  Further, any questionable findings by the veterinarian shall immediately be reported, in writing, to the Seller.  If the Kitten is found to be medically deficient with a terminal or life-threatening problem, Seller shall refund the Purchase Price in full or replace Kitten with another of like kind and quality as soon as a replacement is available. All veterinary expenses and return shipping-related expenses are the responsibility of the Purchaser. Seller’s health guarantee shall be null and void if Kitten is exposed to unsanitary conditions, being in caged environment as a way of life, exposed to other animals in poor condition or unknown illnesses, goes outside of the home, lives with or around smoking of any kind, sustains a life breathing chemicals or cleaning products that are harmful  or any other environmental factors that are deemed harmful and out of sellers control.  
Congenital defects do not include heart murmurs. Heart murmurs can be common in animals and are not life threatening.  Kittens can grow out of heart murmurs usually by the age 6-12 months and up to 2 years of age.  If the kitten still has a grade 4/6 heart murmur at the age of 12 months old and ECH (purchasers’ expense) will be performed by a certified cardiologist.  The cardiologist diagnoses of the kitten must be a terminal case, all medical reports and photo’s of ECHO will be sent to seller. Upon discovery the deficient defect was cause by hereditary & an undouble terminal case then purchaser must notify seller immediately to discuss possible kitten replacement. In as much as the below signed understands and accepts these terms and conditions, they are aware of the penalties to be incurred by violation of this contractual agreement. They are aware that this contract is a legally binding contract by law in the state of North Carolina. They are aware that interstate litigation is within the expenses to be absorbed in full by the BUYER in question at the time of purchase. This is considered to be effectual and enforceable; all disputes will take place in the state of North Carolina and in the Courts under North Carolina Law. If any terms of this contract should become unenforceable, the remainder of the contract shall remain enforceable.  
If Buyer or Seller commences any legal action as a result of this contract, Buyer agrees that the place of venue for such action shall be the state of North Carolina. Any legal fees incurred in upholding this contract will be paid by the Buyer. This contract is legally binding to all parties named within and applies to only the buyer and the seller named below and is not transferable to other parties. If the buyer sells cat/kitten to a 3rd party, the health contract is Null and Void.
